General Terms and Conditions (GTC) for the online shop of the Spiritual Science Research Foundation INC., Australia (shop.spiritualresearchfoundation.org)

Welcome to the Spiritual Science Research Foundation (SSRF) shop, owned and operated by the Spiritual Science Research Foundation INC., Australia (SSRF Australia). SSRF Australia is a non-profit organisation registered in Australia with ACNC (Australian Charities and Not-for-profits Commission) and ASIC (Australian Securities & Investments Commission) – ABN 49119742291.

  1. Scope of application
    1. Orders placed via shop.spiritualresearchfoundation.org (online shop) are subject to the following General Terms and Conditions in the version valid at the time of the order. Conflicting, deviating or supplementary general terms and conditions of the customer (consumer or entrepreneur) shall not become part of the contract unless the SSRF expressly agrees to their validity.
    2. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
    3. An entrepreneur is a natural or legal person or a partnership with legal capacity who or which, when entering into a legal transaction, acts in the exercise of his or their trade, business, or profession.
    4. Individual arrangements and agreements must be expressly confirmed in writing.
  2. Contractual partner and conclusion of contract
    1. The contracts concluded via our website shop.spiritualresearchfoundation.org are concluded with the Spiritual Science Research Foundation INC., Australia (hereinafter: ‘SSRF’).
    2. The presentation of the products in the online shop does not constitute a legally binding offer, but only an invitation to place an order. By clicking on the ‘Place Order’ button, the customer places a binding order for the goods listed on the order page and selected by the customer. The purchase contract is concluded at the time at which the SSRF declares acceptance of the customer’s offer by email. The dispatch of the ordered goods is also deemed to be acceptance.
    3. The order is usually processed within 3 to 5 working days, calculated from the day following the day of the order. Saturdays, Sundays, and public holidays do not count as working days.
    4. SSRF is entitled to restrict and/or discontinue the availability of content, products, services, or other functions of the online shop, to ask the customer for additional information, and to cancel the order if needed (SSRF will inform the customer of this by email).
    5. SSRF is entitled to withdraw from the contract with the customer after its declaration of acceptance and not to dispatch the goods to the customer if suspicion of misuse of the customer account, fraud or similar conspicuous activities are detected by SSRF. SSRF shall inform the customer of this by email. Any payment already paid by the customer will be refunded immediately.
  3. Contract repository

      The text of the contract, in particular the order, is stored by SSRF with the exception of the GTC applicable at the time of the conclusion of the contract and sent to the customer on request. SSRF shall send the GTC to the customer by email with the order confirmation so that the customer has the option of printing and/or saving them. The currently valid GTC can also be viewed at any time in the online shop and printed and/or downloaded using the browser’s save as function.

  4. Contract language

      The contract language is English.

  5. Delivery and Customs Duties/Taxes
    1. Unless a fixed timeline or date has been agreed in writing, delivery will be made as soon as possible after full payment of the purchase price and shipping costs by the customer. As a rule, the delivery time might vary between 3 to 4 weeks from receipt of payment by SSRF. If an agreed delivery date is not met, the customer must set a reasonable grace period, which must not be less than two weeks.
    2. Deliveries from or to foreign countries can only be made possible on the condition that the customer assumes full payment of any customs duties and taxes levied by the competent authorities of his country. The customer will be informed of this when placing the order.
    3. Should any individual items of an order be temporarily unavailable or undeliverable, SSRF shall inform the customer immediately. If an item is permanently unavailable, SSRF shall refrain from issuing a declaration of acceptance. In this case, a contract is not concluded.
  6. Prices

      The prices quoted on shop.spiritualresearchfoundation.org are in USD, AUD, EUR & GBP and include the applicable statutory tax. The prices stated on shop.spiritualresearchfoundation.org are subject to change at any time.

  7. Dispatch and shipping costs
    1. The order is delivered by shipment. The corresponding shipping and packaging costs are indicated to the customer during the ordering process and are to be borne by the customer.
    2. The SSRF reserves the right to adjust the packaging and shipping costs at any time if this is necessary due to postage increases or to cover costs.
    3. If the ordered item cannot be delivered because the delivery address is incorrect or when the person is not at home to collect the package or because the customer has not paid the customs duties or taxes and the item is therefore returned to SSRF, it can only be reshipped after the customer has paid the shipping costs in full again. The contract remains in force in such a case. The provisions on the consumer’s right of cancellation remain unaffected.
  8. Cancellation policy and consumer information

    Cancellation policy

    1. Right of cancellation

      Consumers have the right to cancel this contract within fourteen days without giving any reason.

      The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, cancels the contract,

      1. have taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are or will be delivered uniformly;

      2. have taken possession of the last goods, if you have ordered several goods as part of a single order and these are delivered separately;

      3. have taken possession of the last partial consignment or the last piece, if you have ordered goods that are delivered in several partial consignments or pieces.

You can use the attached sample cancellation form, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.

    2. Consequences of cancellation

      If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

      We may refuse to refund you until we have received all the goods from the cancelled contract.

      You must return or hand over the goods to us at the below address immediately and in any case within fourteen days at the latest from the day on which you inform us of the cancellation of this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired.

      You bear the direct costs of returning the goods. For returns from abroad, you must bear the return costs in full.

      You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

    3. Exclusion of the right of cancellation

      Unless the parties have agreed otherwise, the right of cancellation does not apply to the following contracts:

      1. Contracts for the supply of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;

      2. Contracts for the supply of sound or video recordings or computer software in a sealed package if the seal has been removed after delivery;

      3. Contracts for the supply of calendars;

      4. Contracts for the delivery of newspapers, magazines or periodicals with the exception of subscription contracts.

      The courts of Melbourne, Australia shall be solely competent for any claims arising out of or in connection with this policy and the respective contract between SSRF and the customer.

  9. Payment modalities
    1. The delivery of goods is only possible against prepayment. The goods will only be delivered upon receipt of the full invoice amount (purchase price plus shipping and packaging costs).
    2. The invoice amount is due for payment upon receipt of the invoice by the customer. Payments are to be made without deduction to one of the accounts specified in the invoice.
    3. Payment can be made with a credit card accepted by the SSRF or via Paypal.
  10. Retention of title

      The goods remain the property of the SSRF until full payment has been made. Goods may not be transferred until payment has been made in full.

  11. Warranty for material defects, guarantee
    1. The SSRF is liable for material defects and defects of title in accordance with the applicable statutory provisions, in particular, unless otherwise stipulated in these General Terms and Conditions.
    2. The SSRF excludes liability for slightly negligent breaches of duty, insofar as this does not concern guarantees or essential contractual obligations (i.e. obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may rely) and does not concern damages resulting from injury to life, limb or health. Claims under the Product Liability Act remain unaffected.
    3. Additionally, under no circumstances will the SSRF be liable for any indirect, incidental or consequential losses or damages of whatever nature arising from the use of SSRF’s products and services. SSRF products and services are provided to effect spiritual remedies for problems that have their root cause in the spiritual dimension. The effect of usage of these goods and services may vary for each person.
    4. An additional guarantee only exists for the delivered goods if this has been expressly agreed with the customer.
  12. Copyright protection 

      All SSRF publications are protected by copyright. In particular, it is prohibited to reproduce them (copyright).

  13. Final provisions
    1. Contracts between the SSRF and the customer shall be governed by the law of Australia without the conflict of law rules of private international law and to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The statutory provisions restricting the choice of law and the applicability of mandatory provisions, in particular of the country in which the customer as a consumer has his habitual residence, remain unaffected.
    2. The courts of Melbourne, Australia shall be solely competent for any claims arising out or in connection with these GTC and the respective contract between SSRF and the customer.
    3. The SSRF is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
    4. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the SSRF in connection with the business relationship shall be the registered office of SSRF.
    5. The contract shall remain binding in its remaining parts even if individual points are legally invalid. The ineffective points shall be replaced by the statutory provisions, where applicable.
